Abstract

Tunisia’s Independent High Authority for Elections faced a formidable task in May 2011. The newly created commission had five months to organize and implement elections for a National Constituent Assembly that would rewrite the Tunisian constitution. Commissioners moved quickly to build capacity and restore public faith in elections. The commission navigated the pressures of a compressed electoral calendar, an agitated electorate, and skepticism of the transitional government. The story of the group’s efforts to manage a successful election offers insight into how an electoral commission can take advantage of relationships with political parties, government, and the public to overcome inexperience in volatile circumstances. This case study focuses on commission staffing and recruitment, the creation of regional subsidiary bodies, and voter registration.

In this interview, James Wallace describes his experiences as the Director of Training of the National Elections Commission of Liberia during the country’s 2005 elections. Wallace discusses the preparations undertaken by the commission prior to the elections, including boundary delimitation, civic education and voter registration. As Liberia was just emerging from a civil conflict, there were a number of obstacles that made these processes particularly difficult. And because of this extraordinary situation, extraordinary methods had to be employed, including, for registration purposes, the use of language and accents as a means for officials to identify individuals as being Liberians, as well the use of a vouching system in which prominent Liberians could vouch for the citizenship of fellow community members. Wallace emphasizes the importance of community involvement throughout voting processes, through consultations with local leaders during boundary delimitation and in educating the electorate. He goes on to describe the logistics behind polling centers and the breakdown of responsibilities of workers as well as the mechanisms, both technological and logistical, employed to prevent fraud. Wallace concludes by emphasizing the importance of teamwork, openness to criticism and innovation to success for anyone with similar responsibilities.

Restoring Voters' Trust and Confidence: Albania's Central Election Commission, 2001-2006

Abstract

When he became head of Albania's Central Election Commission in February 2001, Ilirjan Celibashi faced a difficult task. Three years earlier a new constitution enshrined the commission as a non-political body charged with overseeing Albania's historically troubled elections. The permanent commission aimed to promote bipartisan cooperation and restore trust in the political system after violence gripped Albania's capital, Tirana, in the wake of 1996 national elections that the international community labeled as fraudulent.  During its first three years, the commission failed to achieve substantial reforms largely because of the partisan leadership of its chairman. When Celibashi, a former lawyer and judge, took over as head of the CEC, he had to overcome a highly politicized environment, and he set out to enact reforms to restore confidence in the commission and the electoral process. His reforms concentrated on four priority areas: staffing the CEC with competent people, ensuring transparency for the commission's activities, assembling voter lists and overseeing local election commissioners. In 2008, the political parties removed the commission from the constitution and reinstated it as a political body, erasing most of Celibashi's reforms. The case provides insight into how and why a window of opportunity opened for reform, explores how an individual was able to enact changes in a highly politicized environment and considers reasons why the changes were short-lived.

Keeping the Peace in a Tense Election, Ghana, 2008

In 2008, Ghana held a peaceful run-off in a hotly contested presidential race, breaking the pattern of violence that had afflicted elections in Nigeria, Kenya, Zimbabwe and several other African countries during the same period.  Since the advent of multi-party democracy in 1992, Ghana had held three consecutive elections that observers regarded as relatively free and fair. However, the 2008 presidential race generated concern. Previous elections had revealed substantial ethnic block voting, raising allegations of misbehavior by the two major parties both during the campaign and on polling day. Tensions were increased further in 2008 by the closeness of the initial ballot, which forced the country's first run-off in which the outcome was genuinely uncertain. This case study analyzes the measures taken by the Electoral Commission and other bodies to reduce the likelihood of violence, including an emphasis on transparency as a way to build trust.  With the help of other groups, the commission also organized a system for identifying potential trouble spots, mediating, and building cooperation.  In large part because of these efforts, Ghanaians experienced a peaceful transfer of power.

Nurturing Democracy in the Horn of Africa: Somaliland's First Elections, 2002-2005

A decade after the former British protectorate of Somaliland severed ties with the rest of Somalia and declared independence, the fledgling state took the next steps toward democracy by holding direct elections. This transition occurred over the course of four years and three elections, during which the people of Somaliland elected district councils in 2002, a president and vice president in 2003, and a parliament in 2005. Somaliland’s democratic elections, the first in the Horn of Africa since 1969, were landmark achievements, as traditional social and political mechanisms legitimized the results and reinforced stability in the aftermath. The inexperienced and under-resourced National Electoral Commission successfully navigated the development of political parties, avoided the potential for violence when the margin of victory in the presidential election was only 80 votes, and managed an improved parliamentary election by introducing innovations that made the electoral process operate more smoothly. By avoiding violence and building consensus for peaceful, democratic transitions, Somaliland’s first elections highlighted a mix of traditional and democratic innovations conducted in a resource-poor environment.

Implementing Standards without the Force of Law: India's Electoral Conduct Code, 1990-2001

T.N. Seshan took over as head of the Election Commission of India in 1990, when negative campaigning was on the increase. Candidates appealed to voters on caste and communal lines, sometimes provoking violence. A voluntary Model Code of Conduct, designed to help moderate the excesses of political parties during elections, had lain dormant since its creation 30 years earlier. During the next 11 years, Seshan and his successor, M.S. Gill, worked to elevate the code’s norms and to elicit compliance. Although some campaign excesses persisted, by 2010 the code had become an effective tool for shaping electoral tactics and the behavior of political parties in India. This case offers insights into how to build acceptance of standards that have no force of law.

Enhancing Security to Restore Credibility: Safeguarding Elections in the Philippines, 2008-2010

Citizens of the Philippines braced for renewed election violence in 2010, as bitter political feuds and longstanding family rivalries simmered. Candidate-hired private militias and other armed political groups threatened to disrupt presidential and local voting, as they had in 2004. The job of building safety, trust and credibility into the electoral process fell to Jose A.R. Melo, a former associate justice of the Supreme Court who took over as head of the Commission on Elections in 2008, after a series of scandals that culminated in the resignation of the panel’s chairman. Appointed by the nation’s president, Melo recognized the urgent need to restore trust and credibility to the electoral process. While working to automate the balloting process, Melo sought a broader approach to reducing electoral violence. In conjunction with the police and army, Melo devised and implemented stricter rules regarding weapons and security personnel, and he organized a network of security centers that enforced the new rules.  The May 2010 elections experienced less violence than the previous presidential and local elections in 2004, although questions arose over the susceptibility of the security forces to political coercion.

Cooling Ethnic Conflict Over a Heated Election: Guyana, 2001-2006

On 28 August 2006, Guyana held its most peaceful election in decades. In previous polls, inefficiencies in the electoral process had fueled rumors of electoral fraud by the ruling party, inflaming violent tensions between Guyana’s two main ethnic groups, the Indo-Guyanese and Afro-Guyanese. Ethnicity and party affiliation had long been linked in Guyanese politics. In the run-up to the 2006 vote, the elections commission, international donors and civil society groups worked together to thwart election-related violence. The commission rebuilt trust in the voter registry, decentralized administrative processes, improved field communications and better coordinated security plans. Recognizing the media’s role in fomenting violence, the commission established a Media Monitoring Unit and urged media outlets to cooperate to draft and abide by a new voluntary code of conduct. At the same time, civil society groups instituted a series of peace-building initiatives that included high-level dialogues and grassroots forums. These efforts helped ensure a free and fair election, with results accepted by all parties. Although violence reemerged in 2008, these reforms provided a foundation for renewed counter-efforts before the 2011 elections. This case offers insights to reformers seeking to break the cycle of electoral violence in ethnically divided societies.

A Path to Peace: Liberia's First Post-War Elections, 2004-2005

In 2005, Liberia held its first post-conflict elections, two years after a peace agreement ended 14 years of civil war. Navigating treacherous political waters and facing both time constraints and citizen skepticism, Frances Johnson-Morris, chairwoman of the newly installed National Elections Commission, oversaw a largely peaceful electoral process that ushered in a new legislature and president. A former Supreme Court chief justice, she knew that failure to hold credible elections could plunge the peace process into disarray and send the country back into conflict. To dampen the risk of violence, Johnson-Morris prioritized building citizens’ trust in the commission and took steps to ensure the elections were as inclusive as possible. She established a vetting process to hire qualified staff for the commission and conducted a thorough update of the voter registry that ensured people who lacked standard identification papers could still sign up to vote. Johnson-Morris also oversaw the design of a consultation committee that put political party representatives and elections commission staff in one room, where they could share important messages and formulate unified policy. Ordinary Liberians and independent observers expressed satisfaction with the free, fair and peaceful conduct of the elections.

Policing Election Day: Vulnerability Mapping in India, 2006-2009

During India’s 2009 election, there were not enough uniformed personnel to guard every one of the country’s 828,000 polling places or to keep the peace during the campaign period. The Election Commission of India introduced “vulnerability mapping” to help election officials decide where to deploy the police and paramilitary personnel ahead of polling day. The state of West Bengal piloted the new tactic. Intense political competition and a Maoist insurgency in some parts of the state meant West Bengal was more susceptible to trouble than many other places in the country. Using general guidelines drawn up by the commission, the head election official for West Bengal, Debashis Sen, classified polling stations by their level of sensitivity. These rankings helped election officials decide where to position the police and paramilitary. The commission also instructed the police to execute existing arrest warrants and to keep close tabs on likely offenders. Election officials in West Bengal said the mapping helped dampen violence and increase voter turnout on election day.
